1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website located at https://thedailychapter.com.au/ (the "Website"), and all content, blogs, serialised fiction, and other materials made available on it (collectively, the "Content"), operated by The Daily Chapter Collective Pty Ltd trading as "The Daily Chapter" ("we", "us", "our").

By accessing the Website, creating an account, or subscribing to any paid membership tier, you ("you", "your", "User", "Subscriber") agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, you must not access or use the Website.

We may amend these Terms from time to time in accordance with clause 12 (Changes to These Terms). Your continued use of the Website following any amendment constitutes acceptance of the amended Terms.

2. Definitions

"Account" means the personal account you create to access the Website and Subscription Content.

"Subscription" means a recurring paid membership that grants access to some or all of the Content.

"Content" means all blog posts, articles, fictional stories, chapters, artwork, audio, and other material published on the Website, whether free or paid.

"Creator" means The Daily Chapter Collective Pty Ltd, its employees, contractors, and any authors engaged to produce Content for the Website.

"Australian Consumer Law" or "ACL" means Schedule 2 to the Competition and Consumer Act 2010 (Cth).

3. User Eligibility

To create an Account or purchase a Subscription, you must:

be at least 18 years of age, or the age of legal majority in your State or Territory, or otherwise have the consent of a parent or legal guardian to enter into these Terms;

have the legal capacity to enter into a binding contract in Australia;

provide accurate, current, and complete registration information, including a valid email address and payment details; and

not be a person barred from receiving our services under Australian law or the law of any other applicable jurisdiction.

You are responsible for maintaining the confidentiality of your Account login credentials and for all activity that occurs under your Account. You must notify us immediately at [insert contact email] if you become aware of any unauthorised use of your Account.

We reserve the right to refuse registration, suspend, or terminate an Account at our discretion where we reasonably believe these eligibility requirements have not been met, subject to any rights you have under the ACL.

4. Subscription, Billing and Cancellation

4.1 Subscription Plans

We offer one or more paid Subscription tiers as described on the Website at the time of purchase. Plan features, pricing, and included Content may vary between tiers and are as set out on our pricing page at the time of your purchase.

4.2 Recurring Billing

Subscriptions are billed in advance on a recurring basis (monthly, or annually, as selected by you at checkout) using the payment method you provide. By subscribing, you authorise us (or our third-party payment processor) to charge that payment method automatically at the start of each billing cycle until you cancel in accordance with this clause.

All prices are quoted in Australian Dollars (AUD) and, unless stated otherwise, are inclusive of Goods and Services Tax (GST) where applicable.

4.3 Cancellation

You may cancel your Subscription at any time via your Account settings on the Website, or by contacting us at subscribers@thedailychapter.com.au. Cancellation will take effect at the end of your current billing cycle, and you will retain access to Subscription Content until that date. We do not provide pro-rata refunds for the unused portion of a billing cycle except as set out in clause 4.5 or as required by law.

We will provide a cancellation method that is at least as simple as the method by which you subscribed, and we will not impose unreasonable barriers to cancellation.

4.4 Cancellation and Refunds Policy

If your subscription consists of both a digital membership and newsletter delivery subscription, you may not cancel just one component. Please contact us to discuss other subscription alternatives that may suit your needs.

The following applies regarding refunds.

1. If your Subscription requires you to pay :

a) Subscription fees in advance every 4-weeks; or

b) Subscription fees in advance monthly; or

c) An initial payment which is stated to be non-refundable in the offer terms, then those prepaid fees are not refundable, in whole or in part, unless:

d) The Daily Chapter cancels your subscription, other than due to a breach by you of any of our terms and conditions;

e) You or The Daily Chapter cancel your newsletter delivery because we are no longer provides email delivery to your mailbox; or

f) It is required by law.

4.5 Price Changes

We may change Subscription pricing from time to time. We will give you at least 30 days' notice of any price increase that affects your existing Subscription, by email or by notice on the Website. If you do not agree to the new price, you may cancel your Subscription before the change takes effect.

4.6 Failed Payments

If a payment fails, we may retry the charge, suspend your access to Subscription Content, and/or contact you to update your payment details. Continued failure to pay may result in suspension or termination of your Account.

5. Intellectual Property

5.1 Ownership

All Content published on the Website — including all blog posts, articles, fictional stories, characters, chapters, titles, artwork, graphics, logos, and the overall look and feel of the Website — is the intellectual property of the Creator and/or The Daily Chapter Collective Pty Ltd, and is protected by Australian and international copyright, trade mark, and other intellectual property laws. Nothing in these Terms transfers any ownership of intellectual property to you.

5.2 Limited Licence to Subscribers

Subject to your compliance with these Terms and payment of any applicable Subscription fees, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and view the Content solely for your own private, non-commercial enjoyment.

5.3 Prohibition on Redistribution

This licence does not permit you to, and you must not, without our prior written consent:

copy, reproduce, republish, upload, post, or transmit any Content to any other website, platform, forum, social media account, messaging service, or file-sharing service;

download, screenshot, scrape, or otherwise extract Content for the purpose of redistribution;

sell, rent, lease, sublicense, or otherwise commercially exploit any Content;

create derivative works, adaptations, translations, fan continuations for public distribution, or summaries of Content intended to substitute for the original, without permission;

remove, obscure, or alter any copyright, trade mark, or other proprietary notice contained in the Content; or

use any automated means (including bots, scrapers, or AI training tools) to access, copy, or ingest Content for any purpose, including training machine learning or generative AI models.

Unauthorised use of the Content may infringe copyright and other laws and may result in civil or criminal liability. We reserve the right to pursue all available legal remedies, including termination of your Account and injunctive relief, in respect of any breach of this clause.

5.4 Feedback and User Submissions

If you submit comments, reviews, or other feedback to us (for example, via comments sections or contact forms), you grant us a perpetual, royalty-free, worldwide licence to use that feedback for the purposes of operating and improving the Website, without any obligation to compensate you.

6. Prohibited Conduct

When using the Website, you must not:

infringe the intellectual property, privacy, or other legal rights of us or any third party;

share, sell, or otherwise provide your Account login details to any third party, or access the Website using an Account that is not your own;

circumvent, disable, or otherwise interfere with any security-related features of the Website, including content-protection or paywall measures;

use the Website for any unlawful purpose, or in a manner that breaches any applicable Commonwealth, State, or Territory law;

upload or transmit any material that is defamatory, obscene, harassing, threatening, discriminatory, or otherwise objectionable;

introduce viruses, malware, or other harmful code, or engage in any activity that disrupts or degrades the Website's performance;

engage in chargeback fraud or otherwise seek to obtain Content without authorised payment; or

use any data mining, robots, scraping, or similar automated data-gathering tools on the Website without our prior written consent.

We reserve the right to investigate suspected violations of this clause and to suspend or terminate the Accounts of Users who breach it, in addition to any other remedies available to us at law.

7. Disclaimer of Warranties

7.1 Fictional Content

All stories, characters, names, events, and situations published on the Website that are identified (expressly or by context) as fiction are products of the imagination. Any resemblance to actual persons, living or dead, businesses, events, or locations is purely coincidental unless expressly stated otherwise. Content may include mature themes, and where applicable we will use reasonable efforts to apply content warnings, but you access such Content at your own discretion.

7.2 No Professional Advice

7.4 Australian Consumer Law Guarantees Not Excluded

Nothing in this clause 7 is intended to exclude, restrict, or modify any condition, warranty, guarantee, right, or remedy implied or imposed by the Australian Consumer Law or any other legislation that cannot lawfully be excluded. This clause 7 operates subject to those non-excludable rights.

8. Limitation of Liability

To the maximum extent permitted by law:

neither we, our directors, employees, contractors, nor any Creator will be liable to you for any indirect, special, incidental, consequential, or punitive loss or damage (including loss of profits, data, goodwill, or anticipated savings) arising out of or in connection with your use of, or inability to use, the Website or any Content, however caused, whether in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility of such loss;

our total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Website, whether in contract, tort, or otherwise, will not exceed the greater of (a) the total Subscription fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) AUD $100; and

where our liability cannot lawfully be excluded but can be limited, our liability is limited, at our option, to the re-supply of the relevant services or the cost of having the services re-supplied.

This clause 8 does not exclude or limit any liability that cannot lawfully be excluded or limited under the Australian Consumer Law or other applicable legislation, including liability for death or personal injury caused by our negligence, or for fraud.

9. Privacy

We collect, use, and disclose personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference, and in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You may terminate your Account at any time by following the cancellation process in clause 4.4. Clauses 5 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), and 11 (Governing Law) survive termination of your Account.
